I like the idea of punishing those who incite to riot, flag-burning is a good example.
Rioting is a good opportunity to round up society's worst aholes. When damage or unlawful disruption occurs, read an announcement saying: "go home or get arrested" .
Free speech is tricky and I fall on the side of nearly everything is free speech. Rioting too, is tricky because its subjective. When does a protest group cross the line toward rioting? Some things are clear like throwing concrete at officers, but what if they spray paint a wall nearby? It needs a clearly defined statute.
I appreciate the way you framed this. After George Floyd during the "summer of love" there were murals painted in a lot of towns and cities where you could be arrested for painting your own counter-mural. And if you did paint one and someone defaced it, nothing would happen to them, but if you defaced theirs, off to jail you went. A clear double standard and one that cannot hold up to legal analysis. I'm going to enjoy this as it winds its inevitable way through the courts.
